By accessing, purchasing, viewing, downloading, or using a FaxCar vehicle history report (each referred to as a “Report”) from the FaxCar consumer website (www.carfax.guru) (“FaxCar Site”), you agree to these Terms and Conditions. These terms form a binding agreement between you and FaxCar. If you do not agree with all the terms stated herein, you must immediately discontinue your use of the FaxCar Site and any Reports.

FaxCar reserves the right to modify, update, or change these Terms and Conditions at any time without prior notice. Your continued use of the FaxCar Site and Reports after any modifications will signify your acceptance of the updated terms.

1. License for Use

FaxCar provides access to its Reports solely for personal, non-commercial use to evaluate vehicle history. Any individual or business needing Reports for commercial purposes must subscribe to FaxCar commercial offerings, as detailed on www.carfax.guru.

Modification Rights

FAXCAR RESERVES THE RIGHT TO CHANGE, MODIFY, OR DISCONTINUE ANY FEATURE OF THE FAXCAR SITE OR REPORTS AT ANY TIME WITHOUT NOTICE.

2. User License & Restrictions

FaxCar grants you a limited, personal, non-exclusive license to access the FaxCar Site and use Reports for which you have paid. This license does not allow:

Sharing or transferring a Report to third parties, except in relation to a vehicle purchase or sale for personal use.
Commercial Use, including:
- Buying or selling vehicles beyond personal use.
- Reselling, sublicensing, or distributing Reports.
- Analyzing multiple vehicle records for business purposes.
- Using Reports for financial or commercial gain.

3. Prohibited Activities

You are strictly prohibited from:

Using automated tools (e.g., bots, data mining tools) to extract data from the FaxCar Site.
Engaging in web scraping or other automated access methods.
Copying, altering, publishing, or redistributing Reports or any information contained within them.
Using Reports to identify or contact any past or current vehicle owner.

4. Certification of Personal Use

By using FaxCar, you certify that all information provided is accurate and complete and that your use of Reports is for personal purposes only. If FaxCar suspects commercial use, access may be suspended until satisfactory clarification is provided.

5. Commercial Use Violations & Remedies

If FaxCar determines that you are using Reports for commercial purposes, we may:

Suspend, deactivate, or terminate your access without a refund.
Charge you additional fees equal to the standard report price for each instance of unauthorized commercial use.
Pursue legal action if necessary.

6. Disclaimers

No Guarantees: FaxCar does not guarantee uninterrupted access to its Site or Reports.
Accuracy Limitations: FaxCar does not verify or guarantee the accuracy of data in its Reports, which are compiled from third-party sources.
“As-Is” Reports: FaxCar provides all Reports “as is” and expressly disclaims all warranties, including implied warranties of merchantability or fitness for a particular purpose.
